Pomp Rewards Club Terms & Conditions

These Pomp Rewards Club Terms & Conditions (“Rewards Terms”) govern participation in the Pomp Rewards Club (the “Program”) offered by Pomp Beauty, Inc. (“Pomp,” “Company,” “we,” “our,” or “us”).

By enrolling in or participating in the Program, you agree to these Rewards Terms, as well as Pomp’s Terms of Use and Privacy Policy, which are incorporated herein by reference.

1. Program Overview

The Program is a loyalty and rewards program designed to provide eligible customers and/or licensed professionals with the opportunity to earn promotional points in connection with qualifying purchases and activities completed through the Pomp platform.

Points may be redeemed for promotional rewards subject to these Rewards Terms and any additional promotional rules communicated by Pomp from time to time.

2. Eligibility and Participation

Participation in the Program is open to individuals with an active Pomp account who are at least eighteen (18) years of age or otherwise legally authorized to participate under applicable law.

The Program is intended solely for personal and lawful use. Commercial exploitation, resale activity, or abuse of the Program is prohibited.

Pomp reserves the right to refuse, suspend, or terminate participation in the Program at any time and in its sole discretion.

3. Earning Points

Members may earn one (1) point for each one (1) U.S. dollar spent on eligible purchases made through the Pomp platform unless otherwise specified by Pomp in connection with a promotional offer.

Points are calculated based on the final net purchase amount after:

  • discounts,

  • promotional credits,

  • coupons,

  • refunds,

  • returns,

  • store credits, and

  • other adjustments.

Points are not earned on:

  • taxes,

  • shipping or handling charges,

  • gift card purchases,

  • purchases made using gift cards,

  • purchases made using promotional credits or store credits,

  • refunded or canceled transactions,

  • wholesale or professional-discounted purchases (unless expressly permitted),

  • subscription fees (unless expressly permitted), or

  • any transaction deemed ineligible by Pomp.

Pomp reserves the right to determine eligible purchases and qualifying activities in its sole discretion.

4. Redemption of Points

Points may be redeemed only in accordance with redemption options made available by Pomp at the time of redemption.

Current redemption tiers may include:

  • 500 points = $15 reward

  • 1,000 points = $35 reward

  • 2,000 points = $80 reward

Redemption values, thresholds, and available rewards may be modified at any time without notice.

Rewards:

  • have no cash value;

  • are non-transferable;

  • may not be redeemed for cash or cash equivalents;

  • may not be sold, exchanged, or transferred;

  • may only be redeemed through authorized checkout methods; and

  • may be subject to additional restrictions, exclusions, or expiration requirements.

Rewards may not be combinable with certain discounts, offers, subscriptions, promotional campaigns, or other incentives unless expressly authorized by Pomp.

5. Returns, Refunds, and Adjustments

If a purchase associated with earned points is returned, refunded, canceled, disputed, or charged back, Pomp reserves the right to deduct the corresponding points from the Member’s account.

If a reward, discount, or promotional credit was used in connection with a refunded transaction, Pomp may:

  • deduct the value of such reward from the refund amount;

  • reverse associated points; or

  • reinstate points in its sole discretion.

Negative point balances may result if points are reversed after redemption.

6. Point Expiration and Account Inactivity

Points expire twelve (12) months after the Member’s last qualifying account activity unless otherwise specified by Pomp.

Qualifying activity may include eligible purchases, point redemptions, or other activities designated by Pomp.

Pomp reserves the right to deactivate accounts or forfeit accumulated points due to prolonged inactivity, suspected abuse, violation of these Rewards Terms, or termination of a user’s Pomp account.

7. No Cash Value; No Property Rights

Points, rewards, promotional balances, and other Program benefits:

  • are promotional in nature only;

  • are not property;

  • are not redeemable for cash;

  • are not transferable upon death, divorce, or otherwise by operation of law; and

  • confer no vested rights or ownership interests.

Accumulated points do not constitute personal property and may be revoked, modified, limited, or canceled by Pomp at any time.

8. Abuse, Misuse, and Fraud

Pomp may review all Program activity for abuse, misuse, fraud, or violations of these Rewards Terms.

Prohibited conduct includes, without limitation:

  • creating multiple accounts,

  • self-referrals,

  • fraudulent transactions,

  • manipulation of rewards balances,

  • excessive returns,

  • resale activity,

  • abuse of promotional campaigns,

  • unauthorized commercial use, or

  • any activity intended to manipulate the Program.

Pomp reserves the right to:

  • revoke points or rewards;

  • suspend or terminate participation;

  • cancel transactions;

  • close accounts; and/or

  • pursue any other remedies available under applicable law.

9. Program Modifications and Termination

Pomp reserves the right, at any time and in its sole discretion, with or without notice, to:

  • modify these Rewards Terms;

  • change point earning rates or redemption values;

  • modify eligible purchases or qualifying activities;

  • impose redemption limits;

  • add or remove benefits;

  • suspend or terminate the Program; or

  • discontinue any reward or redemption option.

Pomp shall not be liable for any modification, suspension, or termination of the Program or any loss of accumulated points or rewards.

10. Technical Errors

Pomp is not responsible for:

  • delayed, lost, misdirected, or incomplete points activity;

  • system outages;

  • technical malfunctions;

  • processing failures;

  • unauthorized account access; or

  • other errors affecting Program administration.

Pomp reserves the right to correct any errors, inaccuracies, or omissions related to the Program, including point balances or redemption calculations, at any time and without notice.

11. Privacy and Communications

Participation in the Program may involve communications regarding:

  • points balances,

  • rewards eligibility,

  • promotional opportunities,

  • reminders,

  • account activity, and

  • related marketing communications.

Such communications are subject to Pomp’s Privacy Policy and applicable communication preferences selected by the user.

12. Limitation of Liability

To the fullest extent permitted by law, Pomp shall not be liable for any indirect, incidental, consequential, special, or punitive damages arising out of or related to the Program or participation therein.

13. Governing Terms

These Rewards Terms are incorporated into and subject to Pomp’s Terms of Use, including all provisions relating to:

  • limitation of liability,

  • disclaimers,

  • arbitration,

  • class action waiver, and

  • governing law.

In the event of a conflict between these Rewards Terms and the Terms of Use, these Rewards Terms shall govern solely with respect to the Program.
